If you do not agree, please do not access or use the Website. 2.1 Products & Descriptions We make every effort to ensure that product descriptions, images, and ingredient lists on our Website are accurate. All Najah Chemist products are manufactured in Jamaica and are intended for external use only unless otherwise stated. Please read all product labels and ingredient lists before use. Patch Test Recommendation: We recommend that all customers perform a patch test before using any new product. Apply a small amount to the inner wrist or behind the ear and wait 24 hours. If irritation occurs, do not use the product. 2.2 Pricing, Payment & Availability All prices are displayed in Jamaican Dollars (JMD) unless otherwise stated and may be subject to change without prior notice. The price charged will be the price shown at the time your order is placed. We accept the payment methods displayed at checkout, which may include credit/debit card and bank transfer. By submitting payment, you confirm that you are fully authorised to use the payment method provided. All transactions are processed securely using SSL encryption technology. Najah Chemist ensures the availability of products shown on the Website. Should a product become unavailable after your order is placed, we will contact you promptly by email to advise you and discuss your options. 2.3 Orders & Contract Formation An order placed on our Website constitutes an offer to purchase. A binding contract is formed only when we send you an order confirmation. We reserve the right to refuse, cancel, or limit any order, including in cases of pricing errors, stock unavailability, or suspected fraud. 2.4 Cancellations Cancellations will be accepted within 12 hours of an order being placed, provided invoicing and dispatch have not yet been carried out. To cancel, contact us immediately at start@najahchemist.com. After 12 hours, or once an order has been invoiced and dispatched, cancellations will not be accepted. Private label and custom orders are non-cancellable once production has commenced. 2.5 Chargebacks & Payment Disputes By placing an order with Najah Chemist, you agree to contact us directly at start@najahchemist.com to resolve any concerns BEFORE initiating a chargeback or payment dispute with your bank or card provider. A chargeback is a forced reversal of a payment initiated through your bank or card network. Filing a chargeback without first contacting us to attempt resolution is a breach of these Terms & Conditions. Najah Chemist retains the following records for every order as evidence of fulfilment: Order details and confirmation, including date, items ordered, and amount paid Payment confirmation and transaction reference number Shipping receipt and courier tracking number issued at time of dispatch Courier records confirming availability or delivery of the package If a chargeback is filed against a valid, fulfilled order, we will submit all available evidence to our payment provider and the relevant card network to contest the dispute. If a chargeback is found to be fraudulent or without merit, you may be permanently prohibited from placing future orders with us. Use of online payment without the account owner's authorisation constitutes fraud, which is punishable under applicable Jamaican law. We will not, under any circumstances, accept a payment dispute based solely on a customer's claimed lack of knowledge of the purchase or disagreement with our delivery process. The fact of establishing a claim with a bank without first contacting us implies a suspicion of potential fraud; we will use order records, payment confirmation, and shipping receipts as evidence to support our position. It is therefore vital that customers always contact us first to clarify any concern. 2.6 All Sales Final — Cosmetics & Personal Care Due to the personal and hygienic nature of our products, all sales are considered final once an order has been dispatched. We do not accept returns or issue refunds for change of mind. Exceptions apply only in the circumstances set out in Section 3.5 (Returns & Refunds). By completing your purchase, you confirm that you have read the product description, ingredient list, and these Terms & Conditions, and that you accept these conditions of sale. 2.7 Uncollected Packages Once a shipping receipt and tracking information have been issued to you, it is your sole responsibility to collect your package from the designated courier (Knutsford Express or Zipmail) within a reasonable time. Najah Chemist is not responsible for packages that are returned, discarded, or lost due to non-collection. If a package is returned to us as uncollected, we will contact you to arrange re-dispatch. Re-shipping fees will apply and must be paid in advance. Refunds will not be issued for uncollected packages. 2.8 User Obligations Users must at all times act in accordance with the law, good faith, and these Terms & Conditions when using our Website. By engaging our private label services, you agree to the following: Minimum order quantities may apply and will be communicated at the time of enquiry Custom formulations or labelling requests are subject to additional lead times and costs You are responsible for ensuring your branded product complies with all applicable laws in your territory Najah Chemist retains ownership of all base formulations; private label clients receive a licence to sell products under their own brand A non-refundable deposit may be required before production commences Full terms for private label engagements will be set out in a separate written agreement between the parties. 2.10 Intellectual Property All content on this Website — including designs, text, graphics, logos, icons, images, product names, formulations, source code, videos, and course materials — is the intellectual property of Najah Chemist or its duly authorised licensors, protected by Jamaican and international intellectual property law. We may share User data with related companies or authorised third parties only as necessary to fulfil our obligations, or where required by law or judicial authority. 2.15 Force Majeure Najah Chemist shall not be liable for any delay or failure to fulfil an order caused by events beyond our reasonable control, including but not limited to natural disasters, acts of God, courier disruptions, supply chain failures, government restrictions, or any other unforeseen circumstances. In such cases, we will notify you as soon as reasonably possible and work with you to find a suitable resolution. 2.16 Governing Law & Jurisdiction These Terms & Conditions are governed by and construed in accordance with the laws of Jamaica. Any disputes shall be subject to the sole and exclusive jurisdiction of the Courts and Tribunals of Jamaica. 2.17 Changes to Terms We reserve the right to update these Terms & Conditions at any time. The version published on our Website at the time of your order will apply to that transaction. PART 3: SHIPPING & RETURNS POLICY 3.1 Shipping Coverage Najah Chemist ships within Jamaica only. We do not currently offer international or overseas shipping. 3.2 Shipping Partners & Fees We ship via two courier partners: Knutsford Express and Zipmail. A delivery fee of JMD $500 applies for your order to be taken to either courier for onward delivery to you. Knutsford Express: Offers Cash on Delivery (COD). You pay for your order total directly to Knutsford Express when you collect your package. No upfront payment to us is required for the order total. Zipmail: Charges JMD $500 for packages under 9 lbs. Zipmail does not offer Cash on Delivery, so your full order total must be paid to us in advance before your order can be dispatched. 3.3 Processing & Dispatch Orders are processed and dispatched within 2–3 business days of payment confirmation. If any issue arises that prevents us from shipping your order (such as stock unavailability or a courier disruption), we will contact you directly to discuss your options. Once your order has been shipped, you will receive a receipt containing your tracking information. It is your responsibility to use this receipt to collect your package from the courier. Najah Chemist is not responsible for collecting packages on behalf of clients. If you have not received your shipping receipt and tracking information, please contact us before attempting to collect your package or raising a dispute with the courier. 3.4 Risk of Loss Once your package has been handed to the courier (Knutsford Express or Zipmail) and a tracking receipt has been issued, responsibility for the package transfers to the courier. Najah Chemist is not liable for loss, theft, or damage that occurs after the package has been accepted by the courier. In the event of a courier-related issue, we will assist you in raising a claim with the relevant courier service. 3.5 Order Issues If your order arrives damaged, incorrect, or incomplete, please contact us within 7 days of delivery with photographic evidence. We will work to resolve the issue promptly, which may include replacement, refund, or credit at our discretion. 3.6 Returns & Refunds Due to the nature of our products (personal care and cosmetics), we generally do not accept returns for change of mind, in accordance with health and safety standards. However, we will offer a replacement or refund in the following circumstances: The product arrived damaged or defective You received the wrong product The product is materially different from its description on our Website To request a return or refund, contact us within 7 days of receiving your order. Approved returns must be returned in their original, unopened packaging. Return shipping costs are the responsibility of the customer unless the return is due to our error. Refunds, where approved, will be processed to the original payment method within 10–14 business days. 3.7 Cancellations Orders may be cancelled within 24 hours of placement by contacting us immediately. After 24 hours, or once an order has been dispatched, cancellations may not be possible. Private label and custom orders are non-cancellable once production has commenced.
